1. Scope
By giving your consent when downloading the terms of use, a contract is concluded between you and AMOR GmbH (hereinafter “Amor”) on the use of the data, in particular image material (hereinafter “content”) provided on the press and dealer portal (hereinafter “portal”) (hereinafter “usage agreement”), of which these terms of use are an integral part. These terms of use shall apply to all content made available on this portal. They regulate the relationship between Amor and the users.
2. Amendments
Amor may modify these Terms of Use at any time without notice. The date of the last amendment is stated at the bottom of this page. Your continued use constitutes your acceptance of the changes made.
3. Copyrights
The contents published on this portal are protected by copyright. This also applies to the compilation of content as a collective work. The content published here was all either created by Amor itself or created for Amor and Amor has acquired the rights of use to the content published here.
4. Rights of Use
Within the framework of the user agreement, you are permitted to use the content within the framework of these terms of use free of charge for your own purposes. To this extent, you are granted a revocable, non-exclusive and royalty-free right to use the content for your own purposes. This right of use is limited by the provisions of these Terms of Use.
Amor makes the contents available for use and download with the proviso that no changes or cuttings may be made to the contents.
Transfer to third parties is prohibited.
The rights of use to content shall only extend to the respective collection period, unless otherwise expressly agreed between the parties at least in text form. In the event that the period of use deviates from the collection period, the user will be informed of the deviating period of use for the respective content.
For press purposes, content may already be used prior to the start of the collection as soon as it is available on the portal.
5. Violation of individual provisions
Should any of the aforementioned provisions be violated, Amor reserves the right to assert claims for damages.
6. Deletion of content, termination
Amor reserves the right to delete content at any time.
Amor reserves the right to terminate the user agreement at any time and without giving reasons and to prohibit further use.
7. Liability
Amor shall be liable for the contents of this portal subject to the following provision in accordance with the statutory provisions.
Amor shall be liable for damage caused by intentional or grossly negligent actions as well as for damage resulting from slightly negligent breaches of essential contractual obligations. In any case, liability shall be limited to the damage typically foreseeable at the time of conclusion of the contract.
The above limitation of liability shall not apply in the case of strict liability and for damages due to injury to life, body or health.
8. Severability clause
Should individual provisions of these Terms of Use be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
9. Applicable law and place of jurisdiction
Any use of this portal and the published contents, as well as any action, acquiescence or omission in connection with the use of this portal, shall be governed exclusively by German law.
For all disputes arising from or in connection with these terms of use, the courts in Hanau/Germany shall have jurisdiction, insofar as this can be permissibly agreed.
10. Alternative Dispute Resolution:
The EU Commission offers the possibility of online dispute resolution on an online platform operated by it. This platform can be reached via the external link http://ec.europa.eu/consumers/odr/. We are not obliged to participate in an arbitration procedure and unfortunately cannot offer participation in such a procedure.
